from your screnshots, it looks like you would expect some sorting artifacts there anyway - especially if your ground plane is one big pair of triangles... are you sure about not having this problem before?
does this mean 3ds textures are now working correctly for you? please let us know if you are still having null errors - if possible isolate the problem in a demo class and we can debug.
