I thought there was a case in the UK where it was determined to be publishing 
because you don't know the owners necessarily of intermediate email systems.
I can't cite a reference because its a vague memory from around 10 years ago.

Also, emails on a mailing list would almost certainly count as publishing even 
without that ruling.
