WebKit wasn't Apple's - It was from originally KDE. Darwin is BSD on top of a Mach microkernel - again, not Apple's code. Giving back some code to open source community is hardly as open as, say, letting people run OSX on Dell hardware (which they have actively stopped people from doing with a recent release).
