Bikies,
     The more important issue at tomorrow's PBMVC meeting is agenda item H.5., 
Ordinance amending 10.17 and 10.18(3) to clarify regulations regarding placement of 
brush, leaves, and yard waste for refuse collection.  This ordinance change came about 
because of an altercation I had last April over people putting leaves and branches in 
the Seminole highway north-bound bike lanes on the downhill section north of the 
Beltline.  I started moving branches and leaves from the bike lane onto the terrace 
whereupon I was attacked by a homeowner.  In defending myself, I stopped the assault 
but broke my hand and got a disorderly conduct ticket.  I got the disorderly conduct 
ticket dismissed.
     I also got the alders on PBMVC to request a change to 10.17 and 10.18(3) because 
it was ambiguous whether people were allowed to place leaves, brush, and garden waste 
in the street for pick-up by the City.  10.17 says you aren't suppose to put such 
debris in the street but 10.18(3) says you can as long as you don't block more than 
1/4 of the street.  Question is what 1/4 of the street: 1/4 all on one side of the 
street, split between both sides of the street, or in the middle of the street?
     The proposed amendment doesn't solve the problem because it just bans putting 
leaves, etc. in bike lanes, bike paths, and streets that are bike routes but now 
explicitly allows putting such material in streets that are not bike routes.  Leaves 
in the street have also been a problem further down Seminole Highway and on Yuma Drive 
where there are no bike lanes.  Both are heavily used by bicyclists.  The proposed 
amendment also does not address which 1/4 of the street people are allowed to block.  
Finally, the proposed amendment is not consistent with s. Wis. Stat. 86.01 which 
requires lit lanterns to warn people if items are placed in the street overnight.
      The recommended action is referral to the City Attorney for redrafting.  The 
Solid Waste Advisory Committee strongly felt that the City should not permit leaves 
and grass to be put in the street.  They  were concerned about liability issues and 
compliance with new DNR rule (NR 151.13) which states that leaves placed out for 
municipal leaf collection not be in roadways that drain to storm sewers.
