Since that stretch of the Cap City Trail is a toll road, will those fined by 
the DNR for
failing to pay the toll have any recourse with DOT? Or would it take an act

Good points. I buy a pass each December by mail and tie-wrap it to the bars of my only bike, so I never think about state trail permits the rest of the year.

I have an important update from Adam Kopp: At my request he evaluated the passability of the construction site for bicyclists. He says that the work is exclusively between the curbs, and so cyclist can get through the area by walking bikes through the construction zone outside the curb. It's not ideal, but beats a three-mile detour.

Politely asking the appropriate officials to minimize disruption of bicycle traffic when executing their projects goes a long way toward getting cycling equal mind share with driving. Simple things like keeping temporary constructions signs out of the bike lanes (unless they are intended to close those lanes) are a huge help. It's usually easy to find out who's running a project (DOT, county, or local) by calling the transportation engineer for the locality. So be an activist!
