What you don't know is that offlist correspondence was engaged in
prior to that past to try and assist him in complying with the GPL
license which we are all subject to when we do development work with
the OpenSRS client suite and distribute that code to others.

I also wanted to specifically address this:

Yes, but then it is a "work for hire" and the "property" of the party
who contracted him, and that person is still free to distribute the
code as well, under the GPL.

He can sell his code, no one was disputing that.  The problem was his
insistence in offline correspondence that he would be taking the stand
specifically to forbid distribution which is clearly permitted under
the GPL.

Many companies make plenty of money selling (and giving away) GPL
code.   This was merely a licensing compliance issue.
