Downloading the roms off of a third party website, that is, off of copies
that somebody has made of the game and made available for people to download
for free would almost certainly violate whatever copyright/licensing deal
Atari had going at the time because you are essentially getting a
nonlicensed copy.  When you buy a cartridge from someone they no longer have
it so you are right there is nothing wrong with that.  As I said this is
pretty much an academic issue with these old systems, nobody is likely to
come breaking your door down with a battering ram over it.  So do whatever
your conscience dictates.

Um, if you're buying a copy off someone or someone gives you their old copy 
of the rom, what would be illegal about that?  The only thing I could see 
being illegal would be if someone burned you a copy, or burned copies and 
sold them.
