It all depends on the terms of use set forth by the copyright holder. In
the case of trade marks like Star Trek and star Wars for examples
Paramount and Lucas decide what those terms of use are. The law will
uphold there copyrights, and there terms of use.
In the case of Lucasfilm they clearly state that Star Wars materials are
not to be given away or sold without written permission otherwise.
