I am not a lawyer, but I think Craig is specifying that the data is a  
compilation / collection. In US copyright law, you cannot assert  
copyright on a collection of facts. Some dictionaries, encyclopedias,  
and even trivia games copyright the intentional mistakes.

These are, perhaps, copyright-worthy, but one could also argue that  
they are also a simple transformation from the known (factual)  
molecular structure into 3D coordinates and conformers using an open  
source code (RDKit).
