Grant, I believe that if you go to Court and tell your story as factfully and calmly as you did here on the Digest, you'll prevail in court. It's not so bad, but you'll be nervous the first time you do it. Bring a photocopy of that Indiana Statute with you, dress like you're going on a job interview, and tell your story in a concise, abridged manner without rambling on and on and on. You'll also be amazed before your turn at bat at how BADLY your fellow pleaders try to defend their tickets with lame excuses, nothing to substaniate their pleas and look like they just crawled out of bed to be there. Do it. A city cop happened to be coming southbound a couple blocks north of this intersection, so he turned on his lights, did a U-turn, and pulled me over. He said there has to be 750 feet of road without cars for me to do that. So, since next car was about 500 feet away,.... I go to investigate the Indiana Code statute he cited I was in violation of. IC 9-21-8-22, which reads: "Sec. 22. A vehicle may not be turned so as to proceed in the opposite direction upon any curve, or upon the approach to, or near the crest of a grade, where the vehicle cannot be seen by the person who drives any other vehicle approaching from either direction within seven hundred fifty (750) feet. As added by P.L.2-1991, SEC.9." Now, the way I interpret that law is that any car within 750 feet in both directions has to be able to SEE me, not that there can't be a car in that area. In my situation, all cars within 750 feet in both directions COULD see me. Grant.... I normally side AGAINST those grousing about citations in this forum, but this case is an exception.. I also feel qualified to respond as I am a Hoosier and lived in the state for 28 years or so and my day job has me reviewing several police reports a day and using them to interpret liability in auto accidents.... It appears to me that you have a valid case... first of all U turns are legal in Indiana (except where posted) so I will presume that a sign was not in the area.. Secondly, the traffic law you quoted was with respect to areas where visibility is restricted by the character of the roadway ( at a curve, or near the crest of a grade....) Since you did not mention any one of these in your description of the area I will assume they are not present. If my two assertions are correct, I fail to understand how IC 9-21-8-22 applies in this circumstance... I suggest you go to the area and take some scene photos to show to the judge as well.... I also feel that your interpretation applies as well with respect to your vehicle being visible. Good luck and let us know how you fare in court....
