I described the EXACT same symptom to a BMW Tech Rep listed in the back of the Roundel back when I was 18. I believe it was the guy at Mighty Motors in the New England area. Surge on acceleration, almost rhythmic. He immediately said, "lean surge." He also suggested I change the O2 sensor. What? I thought a bad O2 sensor made the car run rich. So I went to Advance Auto, bought an O2 sensor for a 1987 Mustang 5.0L. They have 3 different ones, only difference is the length of wire. I ordered the short one, cut off the Ford plug, spliced the BMW plug in with solder and shrink wrap. You have to remove the nickel plating from the wire so the solder can stick! I used some silicon-carbide sandpaper, easy. Voila! Instant fix. Better acceration, smoother everything. Don't get anti-seize on the nose of the new sensor, just the threads. Just for kicks change the fuel filter, and run some Techron, Red Line, or BMW fuel injector cleaner through, too. Change your oil afterwards. Also check for vacuum leaks and missing/popped off vacuum hoses, esp underneath the plenum. The threat of law suits is a strong deterrent to shoddy practices in all businesses. That is a good thing. Certainly there is abuse on both sides, but that is the way of the world. Your insurance bill might be lower due to our liability laws. Insurance companies do plenty of subrogation themselves. Lawyers aren't stupid, they will not risk their time and money to take a frivolous case to court. I have personally saved manufacturers big bucks from frivolous suits, but have also been involved in making them pay out when they were wrong. I've never seen the underneath of an E39 M5, but know that there is a similar concern with the new S54 MZ3's. it was noticed by one of the more active members of the bimmer.org message board. IIRC he cut an access hole in the cover & fashioned some sort of cover for it so he couuld easily jack up the car w/o removing the cover. not a good solution for a new car still under warranty if you're not a fiend for taking everything apart & messing with it, like he is.
