It's not quite that easy. The biggest key is which votes are going to be
replaced by Bush. The Justices all read the news. Its widely known that
the liberals will try and stick it out for four more years if Bush wins,
and vice versa for the conservatives. Thus, if Bush wins, he is likely
to have to try replacing Rehnquist and Scalia, who are both rumoured to be
ready to leave.
Indeed, if you bet that those three would retire under a Bush
administration, you can argue that things probably could get better under
Bush - if he ends up replacing either Rehnquist or Scalia with a moderate.
On the other hand, if Gore wins, your only hope is Rehnquist dying.
