Of course he might have dealt with that in a different way, for example, he could immediately unsubscribe you and suggest that you resubscribe through a web page that forces you to accept that your messages would be archived. Or he could re-write the mailing list software and give subscribers an option that his/her messages are not archived, but in the meanwhile he would have to moderate you.
