This is an interpretation that I've not seen outside of your post. I've seen US officials stating that Hussein and his croneys would be guilty of war crimes for locating human shields at military sites, but not that the people who volunteered would be guilty of those crimes. I also received the impression that many/most of them thought they'd be protecting hospitals, schools, and the like. IMHO, acting to stop the US from deliberately hitting a hospital is not lending aid and comfort to the enemy because the US is not really interested in hitting hospitals. Aiding and abetting the enemy has always meant more than simply giving the enemy a chance to score propaganda points. It has required some form of material aid (including intelligence of course). If they are stupid enough to believe Hussein when he says a military target isn't, and it gets hit then their death is their own fault. If they are at, say, a water treatment plant "protecting it" and survive a nearby hit on a military target, then I really don't see much in the way of aiding Hussein in fighting the US.
