If you can limit telemarketing with a no call list, why can't you regulate spam?

At least one reason is that email has no deterministic method of proving who originated the message, while the telephone system does, because *every* call is billed, but emails aren't. With access to phone company records, I can conclusively prove who it was that called me. I cannot similarly prove who sent me an email. Even if I could, it would (likely as not) trace back to some unsuspecting schlub whose computer was compromised by a spammer and used to spam me.
