Unless a patent already exists for the processes inside of CakePHP, then there will not be a problem going forward. Once the technology is out in the open you cannot go back and patent it. The code itself has all been written by CakePHP team members who have assigned their rights to the Foundation through the CLA (Contributor License Agreement). The main goal as outlined in the CSF mission is to promote development related to CakePHP, this includes legally protecting and defending CakePHP and other assets of the Cake Software Foudnation. We are not in the business of creating legal issues, but we will do what we can to resolve them. This is the reason we chose the MIT license, which is the most flexible for corporations.
The Cake Software Foundation was setup in Nevada because it was the least expensive, centrally located, with lenient corporate policies. More than 50% of the companies listed on the NYSE are from Delaware, so being located in another state is nothing new.
