JUDGE: NAPLES AMENDMENT DISCOURAGING OVERPASS LEGAL
A state administrative law judge has ruled that a Naples comprehensive plan amendment
discouraging the construction of overpasses within the city is legal. Administrative
law Judge Donald R. Alexander issued his preliminary ruling this week. This ruling
isnt official yet and all parties in the case have 15 days to appeal. On Friday,
attorneys for the city of Naples and Collier County government each claimed victory in
the ruling, which doesnt resolve once and for all whether the overpass will be built.

GOP NOTABLES, REV. GRAHAM PRAY WITH CHARLEY VICTIMS
Two weeks after Hurricane Charley slammed this community, the prayer service was to
show support for the weary. But it packed enough political clout to blow away the
party unfaithful. Gov. Jeb Bush and an entourage of GOP political heavyweights held a
prayer service Friday morning at the First Baptist Church of Port Charlotte, with
evangelical powerhouse Franklin Graham, son of evangelist Billy Graham, in tow.

FOOTBALL GAME TURNS INTO CHARITY DRIVE FOR SCHOOLS
The exhibition football game Friday between Barron Collier and DeSoto high schools
didnt count, but every bottle of water, can of food and dollar bill donated sure
will. With students, teachers and parents lined up at the main gate to accept
donations to help Barron Colliers opponent for the evening, the game turned into a
charity drive. But when DeSoto kicked off to start the game, the battle was as fierce
as a football game should be.

REVISED PERMIT APPLICATION CLEARS HURDLE FOR MARINA
A revised environmental permit application filed Friday for the proposed Hamilton
Harbor marina clears an obstacle for the project. Permit reviewers at the state
Department of Environmental Protection had questioned whether they could issue
separate permits to Collier Enterprises for the marina and to the city of Naples to
deepen the existing channel and canal leading to the marina site near Bayview Park.

CANDIDATES TO SUCCEED PORTER GOSS HAVE DIFFERENT FINANCIAL PRIORITIES
All four of the Republican candidates running to succeed Porter Goss in Congress are
pledging to bring federal money back to Southwest Florida. But their financial
priorities are somewhat different even though all tend to mention the same issues. The
District 14 candidates are former state Rep. Connie Mack, Naples doctor Frank
Schwerin, state Rep. Carole Green and former Lee County Commissioner Andy Coy.

IN PERSPECTIVE:
EDITORIAL: COLLIER SCHOOL SUPERINTENDENT
When we first learned of Ben Marlins resignation on Tuesday, we were disappointed. We
were disappointed that Collier County Public Schools would miss his leadership on
programs he started during a busy first year as superintendent. We were disappointed
in Marlin himself, for making a mountain out of a molehill of criticism.

IN FLORIDA
JUDGE: TOUCHSCREEN COUNTIES MUST BE ABLE TO DO MANUAL RECOUNTS
A state rule barring the 15 Florida counties that use touchscreens from doing manual
recounts is at odds with state law, which requires hand recounts in certain close
elections, an administrative law judge ruled Friday. A coalition of government
watchdogs and other interest groups sued the state arguing the law requires provisions
for hand recounts in every county, no matter what voting technology is used.
