The problem is that as far as MCA are concerned any boat that has a commercial 
or trade licence comes under their rules.

There could be a (perceived) difference as well between those boats where 
customers remain on the bank while they are served from the boat and those 
where the customers actually go onto the boat to be served, eg floating cafes 
and restaurant boats.
Because the customers are actually floating, if the boat should sink they might 
get their legs wet.  ;-)
