The former Marsworth yard, which I believe is what triggered this
discussion, is not heritage property.

The authorisation to develop wrt heritage value is decided via the
local Councail (and EH, I assume).  It clearly shouldn't be decided by
the land owner, for conflict-of-interest reasons.  Which means it
shouldn't be up to BW for property it owns.
