it is ok to not sponsor. A permanent resident by definition does not
need a sponsor.
Without looking at the complete rules so helpfully provided by Doug, I
would say that this IS discrimination, based on national origin, which
is clearly illegal unless the job requires a security clearance. A
security clearance may require a native-born American in some cases,
not sure. But citizenship is then a legitimate issue. Otherwise, if
you are applying to be a CF coder in the adult industry let's say and
they don't hire you because they can't be bothered to figure out the
INS regulations, this IS discrimination. Whether it is worth fighting
is a whole other story.
