Well, that's what the Court is for.

And if Congress doesn't like what the court has done, they can always amend
the Constitution

  I do hate to say it, but we do need something official to throw out
laws which violate the Constitution. Congress sure has a hard time
passing laws that don't violate our rights. And in a way, it falls under
the checks and balances duty of the Judicial branch.
