IIRC, this falls under the same laws that make steeling cable and stuff like that illegal.
Unfortunately Windows XP has made it very easy to use somebody else's wireless network without even realizing you are doing it, which puts you in a bad spot. Now, there is also some responsibility to the person that is providing the open gateway, I don't think they can be held criminally liable, however, should you do something while using their network, like say hack into a bank and take money, the person that provided the open gateway can be held liable for negligence.
