Afghanistan didn't have a recognized government.  We either recognized the
royals or the northern alliance.

While I would agree with your statement when speaking of uniformed soldiers
of Iraq, how does that pertain to the new foreign fighters that are swarming
in, out of uniform?

How do you deal with all the people from Syria, Kosovo, Saudi, Egypt and
other third party countries that are there as jihadi?

Iraq, Afghanistan and the USA have all signed the Fourth Geneva Convention.
Obviously none of them were neutral.
