You can't just claim 'we do not recognize your government' and throw away the 
Geneva Conventions. It doesn't work that way: article 2.

Equally. Just like the American Brigade, a force of foreign volunteers, was 
protected in the Spanish Civil War. And the American Brigade in China during 
WWII.

If they are captured you treat them as PoW and you let a competent tribunal 
decide if they followed the rules of land warfare. (According to the same rules 
as the US miltary uses for their own court martials.) If they didn't follow 
them, they don't deserve the protection of the Geneva Conventions.
