I take that back.. Conspiracy is a different crime.

For any crime to occur in California...  You must have the follow,
California Penal codes 20, 21, and 21a.

20.  In every crime or public offense there must exist a union, or
joint operation of act and intent, or criminal negligence.

21.  (a) The intent or intention is manifested by the circumstances
connected with the offense.

21a.  An attempt to commit a crime consists of two elements:  a
specific intent to commit the crime, and a direct but ineffectual act
done toward its commission.

So.. you must have the intent (I am going to kill Joe Blow) and some type of
action (drive to his house with a gun).

In California, you need an overt act to be tried for conspiracy to commit
murder.  Saying I am going to kill someone does not fly.

But say you make a statement like, "I am going to kill Joe Blow", then you
grab a gun and drive over to Joe Blow's house... you have conspiracy.
