Yes, we should hold those other things to higher standards. But we currently don't. And they are already legal. For pot legalization and penalties, we don't have to grandfather in existing behavior, so the crime for driving-while-high can be as stiff as it SHOULD be, rather than trying to pass a change to existing behavior/laws.
Everyone that wants to use or might use pot is not. Many people don't because they are not willing to try it due to possible penalties, they don't want to try it because it is illegal (yes, some people actually care about that), they don't due to the price, or they don't know where they can get it. Both common sense and other similar legalizations (or prohibitions) says that if it is legal, cheaper and easier, more people will do it.
