Please re-read what I said:

"This is not a traditional war between states. This is an asymmetrical war 
against non-state actors. Our rules of warfare need to adapt to the reality of 
that situation if we intend to win this war."

Who would we declare war on exactly? Congress can only declare war on another 
state. The rules of a declaration of war are hopelessly outdated in the era of 
non-state actors with the capacity to carry out 9/11-style attacks. 

The President very clearly stated after 9/11 that we were engaged in a war 
against Al Qaeda and more generally against terrorism that threatens our 
society.
