In order to prove it, wouldn't someone need to INVESTIGATE it, and maybe THINK about it, maybe even DISCUSS it with a few other people?
This is the step that seems to have been skipped. And Congress can certainly pass a law that forbids the company to retain the contracts to manage the ports (they can't stop the sale from going through). They don't actually have to prove anything.
