There is some disagreement as o what powers he has, that could be clarified
as part of a constitutional amendment.

Personally I would say that those powers reside in the judiciary.  But WTF
do I know?

OK, but the President does seem to have the power to order wiretaps and
searches. Sure he doesn't legislate but that actually points back to
Electoral College and being elected by the states as opposed to the people.
