Agreement - which implies agreeing to something yes?

I don't think any nut with a gun should be treated as a soldier.

If I walk into 7-11 and open (on American soil) I am a criminal.  I will be
treated as a criminal.

If during time of declared war I am captured by enemy elements I would
expect to be treated as a soldier.

If I hopped a plane to Pakistan, then snuck into Afghanistan (which didn't
have a government when most of these guys were caught) and started killing
people.  No uniform.  No actual army.  No organization really.  I would
expect to be killed.  

Why?

Because you are at that point not a soldier.  You are a saboteur or a spy,
and either of them can be summarily executed.
