I'm fairly certain that it did based on the first Gulf War.  Had that
not occurred, it would've been more tricky.  So unless Dana has some
legal point to make, she seems to be making the was-it-smart point.

That's a totally different question and of course I'd say hell no.

Then there's the whole question of what we do now that we're there.
I'd say we stay and essentially create a democracy as best we can.  If
Iraq dissolves into civil war, or if the insurgents take over the
minute we leave, or if the country votes to become a dictatorship or
theocracy, then the war will have been for nothing.
