Two notes of clarification (listening to Rush on this topic)

The bill includes provisions stating that no advertising campaign of any
kind may be run to criticize an opponent or an incumbent, which means that
if you think your opponent screwed up the you can't say anything about it
within the 60 and 30 day limits.

Also, most people don't start "researching" who they want to vote for until
the last 2 weeks or so before an election... either that or they've already
made up their minds.

So, I still stick with my logical conclusion that the bill is abridging the
freedom of speech.  Ethical actions of the recipients aside, there's serious
problems with this picture.
