Its not stupidity, its an ideology about the constitution. Cheyney is an out 
and out advocate of the imperial presidency - the concept that since Watergate 
the power of the president has been significantly diminished. And that not only 
should it be back to where it was before the fallout of Watergate, but 
considerably enhanced. The thinking here is almost of the Roman Empire vs the 
Roman Republic to give an example.

Others in the administration take a neo-con ideological stance that the 
constitution is not all that important, and only applies in very select cases. 
Mainly in how the person is to interact with the government. If a right is not 
specifically mentioned in the constitution (or specifically mentioned in the 
positive - the people shall have XXX or the states shall have YYY), then that 
right does not exist.
