Hate Crime laws don't punish hate - you're allowed to hate. Dammit I hate - I hate a lot of things and it's my right as an American to do so! But seriously - Hate Crimes cover existing illegal acts and provide further penalties. Murder is murder but murder under a hate crime might extend the sentence, require restitution or get you labled. The Phelps have commited no crimes that we know of, so they couldn't possibly be convicted of hate crimes. If they, for example, blew up a Gay bar, then all of their materials could be used to prosecute under Hate Crime legislation (which I think is stupid) but until then nothing can be done using existing Hate Crime laws.
