It is a privately owned business, but it operates within a city, within a
county, within a state, within a country.....each level has it's own set of
regulations that must be met in order for a business, private or otherwise,
to operate and serve the public within that arena.

Restaurants have health regulations, fire codes, etc. etc. Most ban
proponents argue that smoking would fit neatly under the health regulations.

I disagree, but I understand their argument.
