Right now the Bush administration claims that it can come into your
home ("the battlefield"), take you into custody, and hold you
indefinitely without process or trial. The issue is jailers that can
claim anything about you they want without challenge.
Unless *a process* gives you the right to have your side heard in
front of an impartial magistrate, nobody will ever know who you are,
where you are, why you're being held, if you'll be able to plead your
case, or if you'll ever be released. Even if you have volumes of
uncontestable evidence to your innocence, doesn't matter, because
nobody will ever know.
Put another way, without process you have a gulag.
If we think America stands for self-evident inalienable rights for all
men, then a gulag is an abomination.
If we think America stands for some rights sometimes for some
arbitrary set of people determined by another arbitrary set of people
when they feel like it, then a gulag is probably no big surprise and
the inevitable outcome.
