Yes, he sold and he lost money.

But then the difference can be defended with "signaling effect".  Put
another way, he'll write off the loss or make it up with other
profits, and chose to take it to signal his displeasure or for some
other signaling.  Don't know.

But, yes, you're completely right - he sold just before a 40% jump in
price and that's a loss.
