That article is from the middle of September. Offshore drilling ban
expired quietly without a fuss on September 30th. A CR funding the
government into next year has already passed. And no Congressional
session (lame duck or otherwise) can pass a bill that would be signed
by the next President. All bills not signed, vetoed or otherwise dealt
with expire with the close of the session they were introduced in.
Anything passed before Jan. 20th would be dealt with by Bush. Any
bills they want Obama to sign would have to be introduced in the new
Congress, composed of the currently elected representatives (as of the
20th).

I have no idea if there will be a fight for the leadership. I hope
there is, but that's a matter for after the elections. That article
does not say what you think it says.
