The politicization of the Justice Department has been well documented
by the Inspector General. They would not have spent time looking for
evidence nor would they have filed charges.

One of the things the new AG will have to contend with is a deliberate
burrowing in of Bush appointees in the Justice Department. There was
an impressive move in Bush's second term in office to convert
traditionally politically appointed positions into career positions,
ensuring that Bush appointees (political appointees) would be kept
over into an Obama administration rather than replaced as they would
have been in previous administration changeovers.

It will take awhile to clean up the mess in the Justice Department.
