False. Dick Cheney has publicly admitted to endorsing and supporting water-boarding, a form of torture banned by Geneva Convention of which the US is signatory along with 150+ countries. That's admission of a war crime. Personally I don't think it's a good idea for a new administration to get in the habit of prosecuting an outgoing administration. However in this case we're in a real pickle. The war crimes are so clear and transparent that ANY of the 150+ countries would be well within their rights to prosecute. I would be very surprised if there's not a "you do something or we're going to" message to Obama right now. This is why I think Holder and the admin has been wishy-washy on what's going to happen.
