The problem is how do you determine who is guilty and who is innocent
if you don't follow the rule of law.   Is KSM guilty, or is he only
accused?  Where's the proof?  Who decided?  How can we ever know if
his interrogation is tainted by torture?

There are reason the burden of proof is on the accuser.  There are
really good reasons we don't have trials in Star Chambers.

Perhaps you trust the government enough to take their word for who is
innocent and who is guilty.  But have lived too long and seen too much
to ever grant them that trust.  That goes for the new administration
as must as for the one that just left.
