Well, only in the sense that law is semantics. The law used to say, "if it ain't defined it's illegal" Then lobbyists led the charge to change it to, "if it ain't defined it's legal and not regulated" Posner is shaken because he's realized that markets, in fact, do fail. Because people fail. Which means gov't is not an enemy, but a must be a successful institution. Which essentially blows the last 30 years of Republican rhetoric out the window. So what we're back to is doing things RIGHT rather than the easy way. It's easy to just blame government and then abdicate responsibility and walk away. That what Hannity and Limbaugh do. It's much harder to actually buckle down and do the work that makes things in government work. So the next time someone tells you, "government sucks!"
