I think the problem there is that you are calling them "facts" but
really they are words and words have different meanings to different
people. In many cases, we can say that there are broadly accepted
definitions that most reasonable people would agree on. In the case of
gender and sex there is a greater than normal gap between the usage by
different groups of people.

I happen to have a number of friends that fit in the murky areas
because I spend a lot of time in alternative sexuality communities.
That makes me more aware of these distinctions than most people would
be but even within, say, the Intersex community (which I'm not really
a part of) there is a great deal of disagreement about what terms to
use and what words mean. If you start adding layers of being part of
different groups that really have a keen interest in language usage
around sexuality (Feminist, Queer, BDSM, etc) and it can become very
complicated very quickly.

I do think it is important, however, that we try and understand how
different people are trying to use language so you can get at what
their underlying meaning is. Scott doesn't see a distinction between
Gender and Sex. It may be because he's not seen the need for a
distinction between a mental model of sexuality and a physical model
of sexuality or it could be that he just has different words to
express the same sort of distinction. Each of those situations,
however, ought to result in a very different conversation as one
revolves around the mind/body dysphoria issue and the other revolves
around semantics.
