This is not a case of legislation from the bench. This is the case of a person thinking there is a law that violates the constitution. Two of three people in this court agreed with him. This is a case of the judges doing what they are supposed to do, rule on the constitutionality of a law.
Agree or disagree the judges are not overstepping here, they just offered their opinion. It will go up to another court and they will offer their opinion. This will get to the US Supreme Court, and they will offer their opinion. I honestly can't say what will happen. Judges are appointed for life, so they can rule on how they truly perceive the law. Elected Officials are different they have to be elected, many of them in places where anybody who made it known they weren't Christian would not be elected. In this way I place more faith in the court because they are not driven by election, but by what they feel is the right thing to do. They are appointed and approved by the President and the Senate; this will help to ensure we get the best people up there. They are people who usually have served in other judicious positions, and the fact they have moved this far speaks well for them. In my opinion the law shouldn't force children to say "under God"; the removal of "under God" doesn't take away from the value of the pledge.
