Can a Jewish couple sue the Catholic Church for refusing to marry them? I think this is a red herring. And, if it ever came to fruition, I would hope the courts would shoot it down.
Any type of religious establishment has 'rules' that its members must adhere to. For many of these religious organizations, homosexuality violates those rules.
