Well it is the argument regarding the death penalty, is it a deterrent or is it revenge?
If it were revenge then it wouldn't be on the books, but because we call it a deterrent we have it on the books. The fact is laws do deter criminals from committing certain crimes, for instance a pick pocket doesn't move up to murder because he has not respect for the laws.
