Tactical surprise? Funny from what I remember of the rules of land warfare what they did was a crime, and turned them into saboteurs. That means you don't even have to try them, you can just shoot them. Don't need to take them prisoner or anything. If you are expecting to be treated as a combatant then you need to look and act accordingly.
