There have been several cases brought on this -- especially on deep-linking to pages below the top level. As far as I've read (/. follows most of them) they just make lawyers on both sides money.
As an aside, I wrote a section on using CFHTTP for ColdFusionMX for Dummies using quicken.com for stock quotes and the weather channel site for examples of CFHTTP GET and POST. Their legal department rejected it and I had to come up with fake sites to demonstrate the same point. Stupid. At least I could keep the google API web service section since that is intended for remote use.
