Agreed that the gun owner, no matter how threatened he felt, first overreacted by getting a gun for a conflict between himself and a child with a 6 lb. dog, and secondly by extinguishing the dog's life because he can with little or no consequences financial or otherwise. We don't know the history between the neighbor and the dog/child, however I think that its safe to assume that this wasn't the first time that they have had a conflict. In the news report it is stated that neighbors said that this was an agressive dog. I'll agree that the guy who shot the dog is a jerk/coward and deserves a heavy fine and possibly jail time for his actions, but that's not the way the law works.
However, I'm not letting the parents of the child (14 year old) off as easy as they are just as culpable in the dog's death as the shooter. Where were the parents in the news report, and why aren't they being questioned by the reporter? They should be the ones to teach the child responsibility, and that the child (and by the legal definition the parents) was/were completely responsible for all of the dog's actions. Legally, the dog is a piece of property, and whatever that property does is the responsibility of the owner of the property. When the dog pooped on the neighbor's lawn, did the child pick it up? When the dog was outside unleashed and unsupervised, did the child make sure that it wasn't acting agressively? Its clear that the child did allow the dog to run loose in the neighborhood, unleashed and unsupervised at least once, and that unfortunately resulted in the dog's death. Dogs are going to do what comes naturally to them, no one is going to hold them responsible for acting as nature has created them. But we, as dog owners, parents, and members of our community are responsible to ensure that no one is harmed or threatened by our pets. We cannot create rules and laws and then bend them for each individual circumstance. If the dog had been an agressive 70 lb. Pit Bull, there wouldn't be as much uproar with the guy shooting the dog. The way the law sees it - a dog is a dog regardless of size, breed or temperment. The way I see it, the responsibility starts with the parents, who need to instill that into the child before we create a nation of blameless and weak-charactered individuals. Bottom line is that if the dog was leashed it would be alive today. I also think that its very sad that the only way this child has learned her lesson on how to act like a responsible adult and properly care for her dog is to have it so brutally taken from her.
