In response to your example, that was a DOS attack and is illegal. Microsoft updates have causes systems including servers to fail and crash, should you be petitioning to have Microsoft prosecuted under this law?

In case it hasn't dawned on you, The crux of the problem is intent. If the web site you referred to meant to launch a DOS attack they should be prosecuted if it's illegal in their country. Microsoft, on the other hand, doesn't *intentionally* crash servers. Frankly, if what was done was with the team leader's knowledge and/or consent, and if what was done is illegal in his country, I would love to see him/her/it prosecuted.
